Federal versus state law
Cannabis legality differs between federal and state law, and the two have not been reconciled.
A state can license and regulate cannabis businesses that remain federally restricted. The April 2026 rescheduling narrowed but did not close that gap.
Practical consequences persist around banking, employment drug testing, firearms purchase, federal housing, immigration, and crossing state or national borders.
